Frequently Asked Questions
1. Do I need a lawyer to file for bankruptcy?
No. Many individuals file “pro se,” which means without a lawyer. We assist by preparing your documents properly and making sure everything is in order, but we do not provide legal advice.
2. What is a Bankruptcy Petition Preparer?
A Bankruptcy Petition Preparer (BPP) is a non-attorney who prepares documents for people filing bankruptcy on their own. We’re authorized under 11 U.S.C. §110 and follow all disclosure rules required by the U.S. Bankruptcy Court.
3. What type of bankruptcy do you help with?
We prepare documents for Chapter 7 personal bankruptcies only — also known as “liquidation bankruptcy.” This is typically for people with limited income who want to eliminate unsecured debt.
4. Do you go to court with me or speak to the trustee?
No. We are not attorneys and cannot represent you in court or speak on your behalf. We provide you with accurate, complete paperwork and instructions on how to file.
5. Can you tell me if I qualify for Chapter 7?
We cannot offer legal advice or make determinations about your eligibility. However, we can help you complete the Means Test form, which is one of the tools the court uses to assess qualification.
6. How long does the process take?
Once we receive all your information and documents, we typically complete your petition within 7 business days.
7. What documents do I need to provide?
You will need to provide:
A list of all debts and creditors
Proof of income (paystubs, tax returns)
Bank statements
Monthly living expenses
Property and asset information
We’ll give you a custom checklist when we start.
8. How much does it cost?
Our flat fee for Chapter 7 document preparation is $200.00
Note: The court filing fee is separate, paid directly to the bankruptcy court.
9. Can I make payments or pay in installments?
Yes. We offer flexible payment options. However, documents will not be released until the full fee is paid.
10. Can you help me file the paperwork?
We will guide you on how to file your completed paperwork (whether by mail, in person, or online, depending on your court). We do not file documents on your behalf.
11. Will bankruptcy stop collections and wage garnishment?
Yes, once you file, the court issues an automatic stay, which typically stops most collections. However, we cannot guarantee outcomes and recommend speaking with an attorney if you’re facing urgent legal action.
12. Do you help with Chapter 13?
At this time, we only assist with Chapter 7 document preparation.
13. Is my information confidential?
Absolutely. We maintain strict privacy policies and treat your personal and financial information with the utmost confidentiality.
14. What if my petition is rejected?
We’ll help correct and refile your paperwork if it was due to a clerical error. If your case is dismissed for legal reasons, you’ll need to speak with a bankruptcy attorney.
15. How do I get started?
